Today, under the cover of protecting databases from digital piracy, some entities are trying to dramatically change the rules governing the use of and control over facts. Claiming that current law is inadequate to combat database piracy or encourage investment, they want to go beyond the repudiated “sweat of the brow” doctrine and create a new federal property right for facts contained in databases. Moreover, they want this right to be virtually permanent and retroactive.
